Division 1 NCAA athletic departments are:

1. Net contributors to their school’s general fund;
2. Self-funded and firewalled from accessing the general fund; and
3. The largest single factor in quality off applicants— the median SAT score of an applicant significantly increases in years following success in football or men’s basketball.

All of the major sports leagues have this exemption. The concept of the league doesn’t work if the exemption doesn’t exist and there is significant economic turbulence in the industry as a result during the competitive period (see: AFL and NFL history as well as the absorption of the ABA by the NBA).

This coupled with these exemptions not implicating essential industries or services means it’s an easy decision to make with near-zero downside.
